Cyber Advisor – Free advice scheme customer terms and conditions v0.2

These terms and conditions apply when you submit an application to receive advice under the Cyber Essentials Free Initial Advice Scheme being run by IASME Consortium Limited (IASME).

By submitting your application, you agree to be bound by these terms and conditions.

Applying for the Free Advice Scheme

    • You will apply for the scheme by completing two qualifying questions on our website here and giving some key information about your organisation.
    • You will receive an introduction via email to a Cyber Advisor.
    • The Cyber Advisor will respond to the introduction within 2 working days to offer you an appointment for the 30 minutes free cyber advice.
    • The call will only last for 30 minutes.
    • The Cyber Advisor will send you a follow-up email containing a summary of the advice given and links to some useful guidance. They will outline suggested next steps you could take with a clear indication of cost. IASME will contact you via email requesting you fill in a feedback form.

Your Obligations

You confirm that your organisation has fewer than 250 employees.

You will use the advice and support provided only for the purposes of improving the cyber security of your organisation or working towards a Cyber Essentials certification.

You confirm that you will not engage in, cause, or allow any actions that could harm the reputation of IASME, NCSC, or the Cyber Essentials Scheme.

In order to help us assess the effectiveness of this scheme, You will provide IASME with brief feedback on the effectiveness of the advice session and offer any suggestions you might have for improving the service. You agree we may contact you by email in order to collect your feedback.

IASME’s Obligations

Subject to availability, IASME will use reasonable endeavours to select one of the Assured Service Providers (ASPS) to provide advice and support to you in a single session of 30 minutes.

IASME will inform you of the identity of the selected ASP as soon as practicable.

The advice and support is expected to explain and give advice on the cyber security of your organisation, particularly around the implementation of the Cyber Essentials controls.

Liability

You will receive free advice directly from the ASPs participating in this Scheme, acting on their own behalf and not as employees, agents, or contractors of IASME.

IASME excludes to the fullest extent permitted by law, all liability for the services provided to you by IASME and the ASP.

IASME’s obligations to you are restricted to the IASME Obligations stated above.

Confidentiality

We will keep the information you provide to us about your organisation confidential and use it only for the purposes of the Scheme, as well as to help us make improvements to this Scheme, the Cyber Advisor Scheme, and the Cyber Essentials Scheme.

Neither you nor we shall make any public statement concerning your involvement in the Scheme. Any proposed public statements must be agreed in advance by both Parties. The anonymised feedback you provide may be used publicly and IASME may contact you to request a public case study or quote.

You confirm that we may share your contact details with one or more ASPs for the purposes of the Scheme.

Law and Jurisdiction

This agreement is subject to English Law and to the exclusive jurisdiction of the Courts in England and Wales.

Termination

IASME may at its sole discretion terminate the Scheme without cause.

Effect of Termination or Expiry

We expect that the ASP will provide any Free Advice which prior to termination or expiry it has contracted to provide to you but you should clarify this with them before entering into any contract with them.
